These Terms and Conditions ("Terms") govern your use of the website www.HVACServices.com (the "Site"), mobile applications, and all heating, ventilation, air conditioning, and refrigeration (HVACR) services provided by HVACServices HVAC LLC ("Company," "we," "our," or "us").

By accessing the Site, requesting a quote, scheduling a service appointment, or engaging our services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, you must immediately cease use of the Site and may not engage our services. These Terms constitute a legally binding agreement between you and HVACServices HVAC LLC.

HVACServices HVAC provides the following services (collectively, "Services"):

The specific scope, timeline, and cost of any service will be outlined in a written service agreement or work order provided to you before work commences. Any services not explicitly listed herein may be provided upon mutual agreement.

By engaging our services, you agree to:

• Provide accurate and complete information when requesting quotes, scheduling services, or communicating with our team.
• Ensure safe and unobstructed access to your property, HVAC equipment, and relevant areas (attic, crawl space, basement, utility room) at the scheduled service time.
• Secure or remove pets, valuables, and fragile items from work areas prior to service appointments.
• Make payment in full within the agreed-upon timeframe as specified in your service agreement or invoice.
• Not tamper with, modify, or attempt to repair HVAC equipment that has been serviced by our technicians without prior consultation.
• Notify us immediately of any known hazardous conditions at the property, including but not limited to asbestos, mold, electrical hazards, or structural issues.

HVACServices HVAC maintains all required federal, state, and local licenses and certifications to perform HVAC work, including but not limited to:

For installations and major modifications, we will obtain all necessary building permits as required by your local jurisdiction. Permit costs, where applicable, will be clearly identified in your service agreement. Permit fees are the responsibility of the customer unless otherwise stated.

All work performed will comply with applicable building codes, including the International Mechanical Code (IMC), International Energy Conservation Code (IECC), and local amendments.

We understand that plans change. The following cancellation and refund policies apply:

Installation Projects: Orders for equipment that has been specially ordered or custom-fabricated are subject to a restocking fee of up to 25% if cancelled after the order has been placed with the manufacturer. If installation has commenced, labour charges are non-refundable.

Maintenance Plans: Annual maintenance plans may be cancelled at any time. Refunds for unused portions will be prorated on a monthly basis, minus a $25 administrative fee.

All content on the Site, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, and software, is the property of HVACServices HVAC LLC or its content suppliers and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The HVACServices name, logo, snowflake icon, and all related names, logos, product and service names, designs, and slogans are trademarks of HVACServices HVAC LLC. You may not use such marks without our prior written permission.

You may not:

• Copy, reproduce, distribute, publish, display, modify, or create derivative works from any Site content
• Use any data mining, robots, or similar data gathering methods on the Site
• Download (other than page caching) any portion of the Site without express written consent
• Use the Site content for any commercial purpose without our prior authorization

HVACServices HVAC provides services across the continental United States through our network of company-owned branches and authorized service partners. While we strive to serve every location, service availability may vary based on:

• Geographic proximity to the nearest service branch
• Technician availability and scheduling capacity
• Weather conditions and seasonal demand
• Equipment brand and parts availability in your region

Emergency service availability is subject to technician dispatch capacity. We will make every reasonable effort to respond to emergency requests within our stated response times but cannot guarantee specific arrival times due to factors beyond our control (traffic, weather, prior emergency calls, etc.).

If we are unable to serve your area, we will inform you at the time of your inquiry and, when possible, refer you to a qualified partner provider.

Quotes & Estimates: All quotes and estimates are valid for 30 days from the date issued unless otherwise stated. Quotes are based on the information available at the time and may be adjusted if site conditions differ from what was described or observed during the initial assessment.

Pricing Transparency: We provide upfront, written pricing before beginning any work. If additional issues are discovered during service that would increase the cost, our technician will stop work and obtain your written approval before proceeding.

Accepted Payment Methods:

Financing: Financing is provided through third-party lenders subject to credit approval. Financing terms, rates, and conditions are between you and the lending partner. HVACServices HVAC does not act as a lender and is not responsible for financing decisions or terms.

Late Payments: Invoices not paid within 30 days of the due date are subject to a late fee of 1.5% per month (18% annually) on the outstanding balance. We reserve the right to suspend services for accounts with overdue balances.

Workmanship Warranty: HVACServices HVAC warrants its labor and workmanship for a period of 2 years from the date of service completion. This warranty covers defects in workmanship only and does not cover equipment failures, damage caused by misuse, negligence, acts of God, or unauthorized modifications.

Equipment Warranty: Equipment manufacturers provide their own warranties, which typically range from 5 to 10 years for parts and may include a limited compressor warranty. Specific warranty terms vary by manufacturer and equipment model. We will register all new equipment with the manufacturer on your behalf.

Warranty Exclusions: The following are not covered under any warranty:

• Damage caused by improper maintenance, misuse, or neglect
• Failure to follow manufacturer-recommended maintenance schedules
• Damage from natural disasters, power surges, or electrical issues beyond the equipment
• Repairs performed by unauthorized third parties
• Normal wear and tear on filters, belts, and consumable components
• Modifications or additions not approved in writing by HVACServices

Warranty Claims: To file a warranty claim, contact us at Call Now or warranty@HVACServices.com with your service order number and a description of the issue.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

• HVACServices HVAC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY.
• OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
• WE ARE NOT LIABLE FOR DAMAGES RESULTING FROM PRE-EXISTING CONDITIONS AT YOUR PROPERTY, INCLUDING BUT NOT LIMITED TO PRE-EXISTING MOLD, ASBESTOS, ELECTRICAL ISSUES, OR STRUCTURAL DEFICIENCIES.
• WE DO NOT GUARANTEE SPECIFIC ENERGY SAVINGS, TEMPERATURE OUTCOMES, OR UTILITY BILL REDUCTIONS. ANY ESTIMATES PROVIDED ARE APPROXIMATIONS BASED ON TYPICAL SCENARIOS AND ARE NOT GUARANTEED.

Some states do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless HVACServices HVAC LLC, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your breach of these Terms
• Your violation of any applicable law or regulation
• Your negligence or willful misconduct in relation to our services
• Any misrepresentation you make regarding your property or equipment
• Any unauthorized modifications to equipment we have serviced
• Any disputes between you and third parties (e.g., landlords, tenants, HOAs) regarding our services

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Informal Resolution: Before filing any legal claim, you agree to first attempt to resolve any dispute informally by contacting us at legal@HVACServices.com. We will attempt to resolve the dispute within 30 days.

Binding Arbitration: Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in Dallas, Texas, or at a location mutually agreed upon.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Jury Waiver: TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES.
